Biography

Dale F. Gardiner has over 35 years of experience in a practice focused on land use law, governmental law, water law, and commercial litigation. He has practiced before the United States Supreme Court and has successfully argued cases before the United States Court of Appeals for the Ninth Circuit, the United States Court of Appeals for the Tenth Circuit, the Utah Court of Appeals, and the Utah Supreme Court.

Representative Projects

Obtained precedent-setting decisions in local governmental law. (Anderson Development Co. v. Tobias, 528 Utah Adv Rep 3 (Utah 2005); In re Disconnection of Territory, 646 P.2d 699 (Utah 1982); and in CERCLA natural resource damage claims litigation Utah v. Kennecott Corp., 801 F.Supp. 553 (D. Utah 1992), appeal dismissed 14 F.3d 1489 (10th Cir. 1994)), cert. denied, 513 U.S. 872 (1994).
Successfully represented Sandy City, City of South Salt Lake, Bluffdale City, Riverton City, Midvale City, and the Town of Daniel.
Drafted congressional testimony presented by the Jordan Valley Conservancy District in support of the Central Utah Project Completion Act.
Co-authored operating agreements for governmental water treatment plants and the Jordanelle and Deer Creek reservoirs.
