Kyle Harvey’s practice focuses on a wide array of corporate, commercial, and international transactions, with an emphasis on data privacy. In particular, Kyle assists clients with:

  • Initial planning steps for entity formation and financing.
  • Executing mergers and strategic acquisitions, private offerings of debt and equity (e.g., SAFEs, convertible note offerings, preferred round investments), and corporate restructurings for both buyer and seller parties.
  • General securities compliance for public and private companies and investor parties.
  • Drafting and negotiating agreements for supply chain, initial confidentiality and NDA matters, SaaS relationships, technology licensing, energy investment (including non-operated oil and gas assets), and data transfer arrangements.
  • Consulting on general data privacy matters, such as compliance with U.S. consumer privacy laws and international data protection regimes.

Recently, Kyle has assisted on seller- and buyer-side transactions ranging from $10 million to $300 million, including through representation of private equity groups and venture capital firms.

When not practicing law, Kyle is a lover of all sports (especially golf, basketball, baseball, and boxing) and he enjoys hiking and hunting with his family.

Professional History

Associate Attorney with Kirton McConkie, Aug. 2019 through Feb. 2021: Member of Kirton McConkie’s corporate and international sections. Involved in drafting deal documents and disclosure schedules for corporate M&A transactions, preparing securities filings and notices (at the state and federal level) for private and public entities, consulting on data privacy matters with respect to domestic and international data protection laws (including CCPA and GDPR), and drafting and negotiating general transactional agreements (e.g., NDAs, data processing agreements, online terms of service and use, SaaS agreements, and supply chain transactions).
