Passed in 1986, the National Childhood Vaccine Injury Act created a no-fault alternative to the traditional tort system.  Under this no-fault alternative, a small amount of money from each vaccine ($0.75 per disease prevented) is set aside in a trust fund, and a person who suffers an adverse reaction sues this trust fund, not their doctor or the vaccine manufacturer. 

The VICP operates differently than traditional litigation and is conducted through the Office of Special Master in the Court of Federal Claims in Washington DC, where less than 200 attorneys nationwide are licensed to practice vaccine injury compensation.  Not all vaccines are covered by the VICP, only injuries suffered as a result of vaccinations recommended for children are eligible for compensation.  Currently, the eligible vaccines are:

  • Measles, Mumps, Rubella (MMR, MM, or MMRV)

  • Pneumococcal conjugate vaccines
  • Hepatitis A
  • Meningococcal vaccines
  • Human Papillomavirus (HPV)
  • Seasonal influenza vaccines
